These terms cover use of asbestosremovalguildford.co.uk and work carried out following an enquiry through it. They are a draft written for this business rather than a generic template, and they are reviewed before launch.

Indicative prices are not quotes

Every price on this website is indicative. The ranges on the cost page and on the service pages describe what work of that type usually costs. They are not offers and they are not binding.

An indicative range given in response to a photograph is also not a quote. It is our best assessment from the information supplied, and it is given free of charge.

A quote is a written fixed price for a specific job at a specific address, issued after access and the material have been confirmed. Only that is binding.

What a quoted price includes

Unless the quote says otherwise, it includes removal of the material identified, wrapping, transport by a registered waste carrier, disposal at a permitted site, and the hazardous waste consignment note.

It does not include:

• making good. Replastering a ceiling, rebuilding a roof, repairing a wall or reinstating a floor
• replacement materials or a new roof, cladding or ceiling
• clearing contents from a building, unless stated
• separate waste streams such as paint, solvent, fuel, gas bottles or refrigeration units
• scaffolding or access equipment, unless it appears as a line on the quote
• surveys, sampling or laboratory analysis, which are priced separately

Where any of those is required we will say so on the quote rather than after the work.

When a price can change

A fixed price changes only where what is found differs materially from what was described or photographed. In practice that means:

• material that turns out to be a different type from the one quoted for, most commonly insulating board where cement was described
• significantly more material than was visible or stated
• damage or deterioration beyond what the photographs showed
• access that is materially different from what was described
• asbestos found in a second location during the work

In each case we will stop, tell you what has changed, and give you a revised price before continuing. Work does not proceed on a changed price without your agreement.

Licensed work

We carry out non-licensed and notifiable non-licensed work directly.

Licensable materials, meaning asbestos insulating board where the work is not short duration, pipe lagging, sprayed coatings and loose fill insulation, are carried out by an HSE-licensed contractor which we arrange and coordinate. In that case the removal contract for the licensed element may be between you and that contractor, and we will make that clear in writing before anything is booked.

Licensed work requires fourteen days statutory notice to the Health and Safety Executive before it starts. That period is set by law and cannot be shortened.

Notifiable non-licensed work

Where material is substantially damaged, or where removing it will substantially break it up, the work becomes notifiable non-licensed work and must be reported to the Health and Safety Executive before it starts. We will tell you when this applies and what it means for the start date.

Your responsibilities

Providing accurate information about the material, its condition and the access. A price given on the basis of an inaccurate description is not a price we can hold.

Providing access on the agreed date, including any keys, gate codes or parking arrangements needed.

Removing contents where the quote is on the basis of an empty or cleared building, and removing paint, solvent, fuel and gas bottles in every case, since those cannot travel on the same load.

Telling us about anything relevant we would not otherwise know: a tenant in the property, a shared or party structure, protected species in the eaves, a neighbour's building attached to yours.

Cancellation

Where you are a consumer and the contract was concluded away from our business premises or at a distance, you have a statutory right to cancel within fourteen days of entering into it, without giving a reason.

If you ask us to begin work within that fourteen day period and then cancel, you may be required to pay for what has already been carried out.

We will confirm this right in writing when a quote is accepted, along with how to exercise it.

Where you cancel outside the statutory period, or where you are not a consumer, we may charge for work already carried out, materials already committed and costs already incurred, such as a scaffolding booking or a licensed contractor's notification.

If something goes wrong

Tell us. Most problems are resolved quickly by somebody coming back out.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else which cannot lawfully be limited.

Where you are a consumer, your statutory rights under the Consumer Rights Act 2015, including the right to services carried out with reasonable care and skill, are unaffected by anything here.
